DIPLOMATIC AND CONSULAR LAW

Program Overview

Degree Course
Format Online
Duration 10 hours
Language English

Diplomatic law is so ancient that no precise origin can be identified, reflecting its foundation in good faith and the principle of pacta sunt servanda. Throughout history, relations between States have never been entirely rigid. In the contemporary international system, diplomatic relations are highly regulated, though the applicable norms are neither purely declaratory nor exhaustive. As a result, diplomatic law remains a constantly evolving legal field.

Consular law, in contrast, has a dual nature: it involves administrative functions regarding nationals abroad and a juridical role in protecting fundamental rights, even of non-nationals. This creates a relationship that is formally administrative but substantively legal. Moreover, consular authorities may subtly introduce principles of jus cogens into the existing legal framework.
